ABSTRACT In the wake of a political project spanning three decades that was committted to a rhetoric of gay pride, a few queer theorists turned to the affect of shame to rethink queer politics in the twenty-first century. This article entertains the possibility of a politics of shame but ultimately suggests that a politics of shame presents an interesting paradox: shame, in one of its most important senses, seems to dissipate when it is made public or when it is shared. (...) That is, the negative and isolating qualities that are constitutive of the affect of shame are negated when it is confessed. To confess one's shame is to destroy it. The impossibility of sharing shame renders it difficult to politicize. Drawing from Freud, Lacan, Jacques-Alain Miller, and Sartre, I posit a notion of shame that is constitutive of a kind of political subjectivity, though is not itself a programmatic politics. According to the Value-Neutrality Thesis, technology is morally and politically neutral, neither good nor bad. A knife may be put to bad use to murder an innocent person or to good use to peel an apple for a starving person, but the knife itself is a mere instrument, not a proper subject for moral or political evaluation. While contemporary philosophers of technology widely reject the VNT, it remains unclear whether claims about values in technology are just a figure of speech (...) or nontrivial empirical claims with genuine factual content and real-world implications. This paper provides the missing argument. I argue that by virtue of their material properties, technological artifacts are part of the normative order rather than external to it. I illustrate how values can be empirically identified in technology. The reason why value-talk is not trivial or metaphorical is that due to the endurance and longevity of technological artifacts, values embedded in them have long-term implications that surpass their designers and builders. I further argue that taking sides in this debate has real-world implications in the form of moral constraints on the development of technology. (shrink)

All else being equal, most of us typically prefer to have positive experiences in the future rather than the past and negative experiences in the past rather than the future. Recent empirical evidence tends not only to support the idea that people have these preferences, but further, that people tend to prefer more painful experiences in their past rather than fewer in their future (and mutatis mutandis for pleasant experiences). Are such preferences rationally permissible, or are they, as time-neutralists contend, (...) rationally impermissible? And what is it that grounds their having the normative status that they do have? We consider two sorts of arguments regarding the normative status of future-biased preferences. The first appeals to the supposed arbitrariness of these preferences, and the second appeals to their upshot. We evaluate these arguments in light of the recent empirical research on future-bias. Childcare robots are being manufactured and developed with the long term aim of creating surrogate carers. While total childcare is not yet being promoted, there are indications that it is ‘on the cards’. We examine recent research and developments in childcare robots and speculate on progress over the coming years by extrapolating from other ongoing robotics work. Our main aim is to raise ethical questions about the part or full-time replacement of primary carers. The questions are about human rights, privacy, (...) robot use of restraint, deception of children and accountability. But the most pressing ethical issues throughout the paper concern the consequences for the psychological and emotional wellbeing of children. We set these in the context of the child development literature on the pathology and causes of attachment disorders. We then consider the adequacy of current legislation and international ethical guidelines on the protection of children from the overuse of robot care. (shrink)

Radical democratic thinking is becoming intrigued by the material situatedness of its political agents and by the role of nonhuman participants in political interaction. At stake here is the displacement of narrow anthropocentrism that currently guides democratic theory and practice, and its repositioning into what we call ‘the nonhuman condition’. This Critical Exchange explores the nonhuman condition. It asks: What are the implications of decentering the human subject via a new materialist reading of radical democracy? Does this reading dilute political (...) agency? Or should this be seen, on the contrary, as an invitation for new voices and demands to enter into democratic assemblages? How might engagement with the more-than-human disrupt or extend theories of radical democracy? Hans Asenbaum and Amanda Machin discuss the human democratic subject both through radical democratic and new materialist lenses. They suggest that a new materialist decentred subject does not lose agency but further gains political responsibility in radical democracy. Jean-Paul Gagnon highlights the possibility of becoming through loss. In losing our anthropocentric arrogance—our understanding of being other and better than animal—we become more connected and discover our place in human-nonhuman assemblages. Melissa Orlie agrees that something can be gained through renouncing dominant human fantasies and presents a ‘radical democratic naturalism’. By renouncing land violence and acknowledging nature’s subjectivity, we can further nonexploitative radical democratic politics. This is where the notion of ‘tidalectic’ processes introduced by James L. Smith is helpful. Focusing on water and the Indigenous knowledges around rivers, he considers how democracy and community can be reimagined as plural, cyclical and attentive to the nonhuman with which the human is inevitably entangled. Diana Leong offers a different approach. Considering the nonhuman from the perspective of Black Studies demands an awareness to how blackness has long been constituted as non- or partially human. While research has focused on financial and social goals in impact investing, we add to the limited research that focuses on how individuals manage identity multiplicity, defined as three or more role identities. Based on our qualitative study of Christian impact investors, we develop a model of identity multiplicity work, explaining how individuals manage their multiple role identities to reduce identity tensions during the process of impact investing. We find individuals engaged in an interactive, ongoing three-step process of identity multiplicity (...) work: prioritizing one of their salient identities, managing their identity multiplicity interrelationships, and reinforcing their prioritized identity. Investors generally prioritized an identity that was neither financial nor social, but rather religious. We also find this identity work implemented through three novel mechanisms: shadowing, one identity casts a shadow over another thereby enabling the simultaneous pursuit of related goals; distinguishing, all identities are retained and at least a minimum threshold of role expectations are met; and surrendering, partial sacrificing of goals of one identity in favor of another identity based on an individual’s self-reflective importance of the role. Our findings offer new insights to multiple identities, impact investing and business ethics literatures. (shrink)

The latter part of the twentieth century saw the Chinese economy moving towards a socialist market economy rather than a planned system. Despite growing interest in Chinese business ethics, little work has examined ethical issues concerning the Chinese sales force. This study draws from existing work on Chinese and Western business and sales ethics to develop hypotheses regarding the perceptions of unethical selling behaviour of modern Chinese salespeople. A survey of Chinese sales executives is conducted and statistically analysed. Results are (...) compared with those reported in previous US-based research with regard to differences in perceptions of unethical selling behaviour. The results indicate that contemporary Chinese salespeople were more favourably disposed than expected towards unethical selling behaviour, and also more favourably disposed than previously studied US salespeople. Younger Chinese salespeople evaluated unethical behaviours more favourably than older ones. The results are discussed, along with implications for theory, practice and future work. (shrink)

This paper depicts a case study of an organizational strategy for the promotion of ethical practice when introducing a new, high-risk, ethically-charged medical practice like Medical Assistance in Dying (MAiD). We describe the development of an interprofessional program that enables the delivery of high-quality, whole-person MAiD care that is values-based and sustainable. A “care ecology” strategy recognizes the interconnected web of relationships and structures necessary to support a quality experience of MAiD for patients, families, and clinicians. This program exemplifies a (...) care ecology approach that addresses common barriers to entry to MAiD practice, and also meets the needs of a variety of stakeholders through the creation of patient and family resources, team supports, standards of practice, professional development opportunities, organizational infrastructure, and community partnerships. We also describe how a thriving care ecology evolves to remain resilient, and to enable integration as the needs of the organization, team and program change over time. The design and development of this program may be adapted to other jurisdictions and organizations where MAiD is introduced, or where new patient populations become eligible for MAiD. This care ecology model may also be applicable to the creation of sustainable programs that provide other morally controversial or novel clinical services. (shrink)

Ethical guidelines for conducting clinical trials have historically been based on a perceived therapeutic obligation to treat and benefit the patient-participants. The origins of this ethical framework can be traced to the Hippocratic oath originally written to guide doctors in caring for their patients, where the overriding moral obligation of doctors is strictly to do what is best for the individual patient, irrespective of other social considerations. In contrast, although medicine focuses on the health of the person, public health is (...) concerned with the health of the entire population, and thus, public health ethics is founded on the societal responsibility to protect and promote the health of the population as a whole. From a public health perspective, research ethics should be guided by giving due consideration to the risks and benefits to society in addition to the individual research participants. On the basis of a duty to protect the population as a whole, a fiduciary obligation to realise the social value of the research and the moral responsibility to distribute the benefits and burdens of research fairly across society, how a public health perspective on research ethics results in fundamental re-assessments of the proper course of action for two salient topical issues in research ethics is shown: stopping trials early for reasons of efficacy and the conduct of research on less expensive yet less effective interventions. In their important paper “Autonomous Agents”, Floridi and Sanders use “levels of abstraction” to argue that computers are or may soon be moral agents. In this paper we use the same levels of abstraction to illuminate differences between human moral agents and computers. In their paper, Floridi and Sanders contributed definitions of autonomy, moral accountability and responsibility, but they have not explored deeply some essential questions that need to be answered by computer scientists who design artificial agents. One such question (...) is, “Can an artificial agent that changes its own programming become so autonomous that the original designer is no longer responsible for the behavior of the artificial agent?” To explore this question, we distinguish between LoA1 (the user view) and LoA2 (the designer view) by exploring the concepts of unmodifiable, modifiable and fully modifiable tables that control artificial agents. We demonstrate that an agent with an unmodifiable table, when viewed at LoA2, distinguishes an artificial agent from a human one. This distinction supports our first counter-claim to Floridi and Sanders, namely, that such an agent is not a moral agent, and the designer bears full responsibility for its behavior. We also demonstrate that even if there is an artificial agent with a fully modifiable table capable of learning* and intentionality* that meets the conditions set by Floridi and Sanders for ascribing moral agency to an artificial agent, the designer retains strong moral responsibility. Experiences of substitute decision-makers with requests for consent to non-therapeutic research participation during the dying process, including to what degree such requests are perceived as burdensome, have not been well described. In this study, we explored the lived experiences of family members who consented to non-therapeutic research participation on behalf of an imminently dying patient. We interviewed 33 family members involved in surrogate research consent decisions for dying patients in intensive care. Non-therapeutic research involved continuous physiological monitoring of dying patients (...) prior to and for 30 min following cessation of circulation. At some study centres participation involved installation of bedside computers. At one centre electroencephalogram monitoring was used with a subset of participants. Aside from additional monitoring, the research protocol did not involve deviations from usual end-of-life care. Thematic analysis of interviews suggests most family members did not perceive this minimal-risk, non-therapeutic study to affect their time with patients during the dying process, nor did they perceive research consent as an additional burden. In our analysis, consenting for participation in perimortem research offered families of the dying an opportunity to affirm the intrinsic value of patients’ lives and contributions. This opportunity may be particularly important for families of patients who consented to organ donation but did not proceed to organ retrieval. Our work supports concerns that traditional models of informed consent fail to account for possible benefits and harms of perimortem research to surviving families. Further research into consent models which integrate patient and family perspectives is needed. All data relevant to the study are included in the article. (shrink)

Kaplan (1990; 2011) argues that there are no unspoken words. Hawthorne and Lepore (2011) put forward examples that purport to show that there can be such words. Here, I argue that Kaplan is correct, if we grant him a minor variation. While Hawthorne and Lepore might be right that there can be unspoken words, I will argue that they fail to show that there can be uninstantiated words.

As of this writing, twenty‐one states have passed laws barring transgender youth‐athletes from competing on public‐school sports teams in accordance with their gender identity. Proponents of these regulations claim that transgender females in particular have inherent physiological advantages that threaten a “level playing field” for their cisgender competitors. Existing evidence is limited but does not support these restrictions. Gathering more robust data will require allowing transgender youth to compete (rather than preemptively barring them), but even if trans females are shown (...) to retain some advantage, this would not have greater moral significance than the many other “fair” physical and economic advantages found across sports. These regulations deprive transgender youth, an exceptionally vulnerable population, from the vast physical, mental, and social benefits of sports. While we advocate for transgender inclusion under our current, gender‐segregated model of sport, we propose changes to the overarching structure that would promote a more inclusive and fairer athletic environment. As software developers design artificial agents , they often have to wrestle with complex issues, issues that have philosophical and ethical importance. This paper addresses two key questions at the intersection of philosophy and technology: What is deception? And when is it permissible for the developer of a computer artifact to be deceptive in the artifact’s development? While exploring these questions from the perspective of a software developer, we examine the relationship of deception and trust. Are developers using deception to (...) gain our trust? Is trust generated through technological “enchantment” warranted? Next, we investigate more complex questions of how deception that involves AAs differs from deception that only involves humans. Finally, we analyze the role and responsibility of developers in trust situations that involve both humans and AAs. (shrink)

Minimally, metaphysical realists hold that there exist some mind-independent entities. Metaphysical realists also hold that we can speak meaningfully or truthfully about mind-independent entities. Those who reject metaphysical realism deny one or more of these commitments. This Element aims to introduce the reader to the core commitments of metaphysical realism and to illustrate how these commitments have changed over time by surveying some of the main families of views that realism has been contrasted with: such as scepticism, idealism, and anti-realism.

Through the presence of BDSM in mass media, it has caught enough attention for it to elicit influence and uneducated inclusion to their lifestyle. I attempt to revive the debate between the abolitionist versus the sex-positive because there is a necessity to provide a critical analysis of BDSM today in the age of (...) post-sex revolution. Despite of the backlash it received from the thinkers from different walks of field, it is an empowering act because there is mutual respect, condemnation of abuse, and recognition of one’s individuality despite of its coercive, violent, and possessive act. Revisions of the King James Version of 1611 continued into the 20th and 21st centuries as literal or word-for-word translations. This development corresponds with a new age in Bible translation that started in the second half of the 20th century, which involves at least six changes in the philosophy of Bible translation. Firstly, Bible translation is characterised by interconfessional cooperation. Secondly, the plain meaning intended in the incipient texts is made accessible to readers. Thirdly, new critical editions of the Hebrew (...) and Greek incipient texts on the basis of new discoveries of texts are utilised. Fourthly, there is the tendency to remove archaic language to make versions intelligible. Fifthly, there is a tendency to use gendered and inclusive language. Sixthly, the move is from print communication, which can be typified as typographic interpretive culture, to electronic or media communication, which can be typified as digital-media interpretive culture, where sound and visuality become prominent as a contextual supplement to words. In the analysis it will be determined which of these aspects are reflected in the Revised Standard Version and its revisions as part of the linear emergence of the Tyndale–King James Version tradition. However, unlike the King James Version, the Revised Standard Version and its revisions failed to achieve widespread approval from satisfied readers, thus opening the door to alternative revisions.Contribution: Instead of viewing the Revised Standard Version and its revisions as new and independent from the Tyndale–King James Version tradition, it is demonstrated that they are a linear continuation of the emergence of the pre-20th century translation complex within this tradition without replicating the success of the King James Version. Coverage highlights a prominent contribution to a central topic in the philosophy and methodology of science. The author offers a full characterization of Rescher's system of philosophy. She presents readers with a comprehensive philosophico-methodological analysis of this important work. Her research takes into account different thematic realms: semantic, logical, epistemological, methodological, ontological, axiological, and ethical. The book features three, thematic-parts: I) General (...) Coordinates, Semantic Features and Logical Components of Scientific Prediction; II) Predictive Knowledge and Predictive Processes in Rescher's Methodological Pragmatism; and III) From Reality to Values: Ontological Features, Axiological Elements, and Ethical Aspects of Scientific Prediction. This insightful analysis offers a critical reconstruction of Rescher's philosophy. The system he created is often characterized as pragmatic idealism that is open to some realist elements. He is a prominent representative of contemporary pragmatism who has made a great deal of contributions to the study of this topic. :In this article, we present an educational intervention that embeds ethics education within research laboratories. This structure is designed to assist students in addressing ethical challenges in a more informed way, and to improve the overall ethical culture of research environments. The project seeks to identify factors that students and researchers consider relevant to ethical conduct in science, technology, engineering, and math and to promote the cultivation of an ethical culture in experimental laboratories by integrating research stakeholders in a bottom-up (...) approach to developing context-specific, ethics-based guidelines. An important assumption behind this approach is that direct involvement in the process of developing laboratory specific ethical guidelines will positively influence researchers’ understanding of ethical research and practice issues, their handling of these issues, and the promotion of an ethical culture in the respective laboratory. The active involvement may increase the sense of ownership and integration of further discussion on these important topics. Based on the project experiences, the project team seeks to develop a module involving the bottom-up building of codes-of-ethics-based guidelines that can be used by a broad range of institutions and that will be distributed widely. Many philosophers are sympathetic to a perdurantist view of persistence. One challenge facing this view lies in its ability to ground prudential rationality. If, as many have thought, numerical identity over time is required to ground there being sui generis (i.e. non-instrumental) prudential reasons, then perdurantists can appeal only to instrumental reasons. The problem is that it is hard to see how, by appealing only to instrumental reasons, the perdurantist can vindicate the axiom of prudence: the axiom that any person-stage (...) has reason to promote the wellbeing of any other person-stage that is part of the same person as that stage. The claim that perdurantists cannot vindicate the axiom, and hence that the view should be rejected, is what we call the normative argument against perdurantism. In this paper we argue that purely instrumental rationality can ground the truth of this axiom, and hence that the normative argument against perdurantism fails. (shrink)

Given the long-standing controversy about whether the brain-dead should be considered alive in an irreversible coma or dead despite displaying apparent signs of life, the ethical and policy issues posed when family members insist on continued treatment are not as simple as commentators have claimed. In this article, we consider the kind of policy that should be adopted to manage a family's insistence that their brain-dead loved one continues to receive supportive care. We argue that while it would be ethically (...) inappropriate to continue to devote scarce acute care resources to such patients in a hospital setting, it may not be ethically inappropriate for patients to receive these resources in certain other settings. Thus, if a family insists on continuing to care for their brain-dead loved at their home, we should not, from a policy perspective, interfere with the family's wishes. We also argue that healthcare professionals should make some effort to facilitate the transfer of brain-dead patients to these other settings when families insist on continued treatment despite being informed about the lack of any potential for recovery of consciousness. Our arguments are strengthened by the fact that patients in a persistent vegetative state, who, when correctly diagnosed, also have no potential for recovery of consciousness, are routinely transferred from hospitals to nursing homes or long-term care facilities where they continue to be ventilated, tube fed and to receive other supportive care. We also briefly explore the question of who should be responsible for the costs of such treatment at the long-term care facility. (shrink)

In this book Fox and Miller define public administration theory and public management doctrine as an orthodoxy that is intellectually bankrupt and democratically unacceptable. Constitutionalism and communitarianism get similar treatment. Next, the authors construct a new theoretical position defined as constructivism and based on critical theory, phenomenology and structuration theory.

In this paper we describe the objectives of teaching medical ethics to undergraduates and the teaching methods used. We describe a workshop used in the University of Liverpool Department of Psychiatry, designed to enhance ethical sensitivity in psychiatry. The workshop reviews significant historical and current errors in the ethical practice of psychiatry and doctors' defence mechanisms against accepting responsibility for deficiencies in ethical practice. The workshop explores the student doctors' own group ethos in response to ethical dilemmas, and demonstrates how (...) the individual contributes to and is responsible for the group ethos through participation and also through nonparticipation. The student feedback about the workshop is reviewed. The Toronto Ethical Sensitivity Instrument was used to assess whether or not the workshop altered sensitivity. Compared to a control group the attenders' sensitivity was significantly increased (on Student's t-test p equals or is less than 0.002). (shrink)

Despite the burgeoning literature on professionalism in other health professions, psychology lags behind in the level of attention given to this core competency. In this article, we review definitions from other health professions and how they address professionalism. Next, we review how this competency evolved within health service psychology (HSP), and we propose a definition. We offer an approach for assessing professionalism within HSP. Consideration is given to strategies and methods for providing effective education and training in this multifaceted competency. (...) In particular, she finds in the late novels of Henry James an alternative to the reductive, pseudoscientific prose of contemporary analytic philosophy, which she argues inhibits the range of possible answers to the basic ethical question "How should one live?"1 James's prose shows "attention to particulars, a respect for the emotions, and a tentative and non-dogmatic attitude to the bewildering multiplicities of life" (LK, p. 27), and thus it exemplifies the Aristotelian ethical conception she advocates.In this essay I want to disentangle Nussbaum's theory of the ethical significance of fictional form—which I endorse—from her preoccupation [End Page 190] with James—which I do not. Far from being, as she believes, egalitarian, humane, and morally responsible, the Jamesian consciousness Nussbaum would have us emulate is elitist, exclusionary, and morally inert; further, in its commitment to indeterminacy, mystery, and obscurity, the Jamesian model is in fact profoundly anti-philosophical.2 I propose instead George Eliot's Middlemarch as exemplary of fiction's potential contribution to "the job of moral philosophy" (LK, p. 138). Nussbaum may admire the subtlety and density of The Golden Bowl, but I will argue that in its narrative strategies and its integration of novelistic perception and philosophic reflection, Middlemarch proves a better ethical guide and a better example of literature that is also philosophy.In making this argument, I will rely on the terms set by Nussbaum herself for the ethical evaluation of fiction. Unlike other philosophers who invoke literature only as a "rich source of examples awaiting illumination by philosophy," Nussbaum insists that analysis of a text's literary properties is the essential methodology of ethical criticism.3 Every aspect of form and style "expresses a sense of life and of value, a sense of what matters and what does not" (LK, p.5). We discover this "sense of life" through close reading; "our engaged experience line by line," as Wayne Booth says, reveals the character of the implied author, the would-be friend urging on us a particular "pattern of desires."4On Nussbaum's reading, James's prose is ethically exemplary because it is "the prose of Aristotelian perception":It depicts in its cadences the moral effort of straining to see correctly and to come up with the appropriate picture or description; its tensions, obliquities, and circumnavigations express the sheer difficulty of finding the right description or picture for what is there before one. If, as James says, to "put" is to "do," showing this is showing moral activity of a valuable kind.(LK, p. 88)But Nussbaum ends up at James because her alternative moral theory begins there, not because moral philosophy that is literary inevitably sounds like James or supports Aristotle.5 As Nussbaum's gestures towards a more general theory of the role of "the novel" in philosophy indicate, novels may share generic features which complement or correct conventional philosophical discourse, but investigating other novels in this way may also lead us to other, non-Aristotelian, non-Jamesian ethical conceptions. My commentary on Middlemarch presents one such alternative. Purpose This short viewpoint is a response to a lead paper on professional ethics in the information age. This paper aims to draw upon the authors’ experience of professional bodies such as the ACM over many years. Points of agreement and disagreement are highlighted with the aim of promoting wider debate. Design/methodology/approach An analysis of the lead paper is undertaken using a binary agree/disagree approach. This highlights the conflicting views which can then be considered in more detail. Findings Four major (...) agreements and four major disagreements are identified. There is an emphasis on “acultural” professionalism to promote moral behavior rather than amoral behavior. This chapter presents a positive philosophy of male sexuality: one that is not rooted in so-called toxic masculinity and which is compatible with gender equality. I argue that, for such a sexuality to be possible, respect is the moral baseline. However, the status quo for male sexuality is shaped by white supremacy and heteronormativity. To resist these values, men must do more than merely cross some minimal moral threshold for permissible sex. Rather, they ought to develop a caring character so (...) that they would want to seek out their own and their partner’s (robust) sexual fulfillment. In his “Noesis and Logos in the Eleatic Trilogy, with a Focus on the Visitor’s Jokes at Statesman 266a-d,” Mitchell Miller explores the interplay of intuition and discourse in the Statesman. He prepares by considering the orienting provocations provided by Socrates’ refutations of the proposed definition of knowledge — namely, “true judgment and a logos” — in the closing pages of the Theaetetus, by the Eleatic Visitor’s obscure schematization at Sophist 253d-e of the kinds of eidetic field discerned by (...) dialectic, and by his discussion at Statesman 277a-278e of the use of paradigms. Miller then seeks to show how the Visitor’s odd medley of geometrical and Homeric jokes at Statesman 266a-d aims, in the language of the Seventh Letter, to “spark” an intuition of the nature of statesmanship, an intuition whose “self-nourishing” motivates the subsequent rejection of the initial definition of the statesman as shepherd of the human herd, the turn to the paradigm of the weaver, and the rejection of bifurcatory division in favor of the non-bifurcatory account of the kinds of art that function as the “limbs” of a well-formed city. We question his contention that Hebrew word identification is fundamentally about roots, excluding verbal and nominal word-pattern morphemes; and we propose that readers use all information available in stimuli, adjusting for volume and usefulness.
